1. Acceptance of Terms
By registering, accessing, or using the HapiRide Sdn Bhd ("the App"), you agree to comply with and be legally bound by these Terms of Use ("Terms").
If you do not agree to these Terms, you must not use the App.
2. Definitions
- "HapiRide" refers to HapiRide Sdn Bhd and its affiliates.
- "User" refers to any individual or entity who registers, accesses, or uses the App.
- "Riding Session" means any transaction where bike riding is initiated, used, and completed by the User.
- "Service" means the access, management, and usage of bike riding via the App.
3. Scope of Service
HapiRide provides access to its network of bike riding through the App. The service includes:
- Real-time bike availability
- Initiation, tracking, and termination of riding sessions
- Payment processing for services rendered
4. Service Fulfillment
4.1. HapiRide operates on a "pay-per-use" model. Once a riding session is initiated by the User, the rental period begins immediately.
4.2. All riding services are considered fully rendered upon completion of each session, as verified by:
- Trip distance and duration recorded by the App
- Ride logs (start time, end time, duration)
- Transaction receipt issued within the App
4.3. Users are responsible for verifying correct connection and riding initiation. HapiRide is not responsible for incomplete or interrupted sessions caused by:
- User negligence or misuse
- Vehicle malfunction due to improper handling
- Network or GPS interruptions
- Third-party interferences
5. Payment, Billing, and Chargebacks
- 5.1. Payment is due immediately upon completion of each riding session.
- 5.2. By using the App, you authorize HapiRide to charge your registered payment method for all completed transactions.
- 5.3. All completed sessions are non-refundable except where service failures are directly attributable to HapiRide's system errors, verified by technical logs.
- 5.4. In the event of a chargeback request or dispute, HapiRide will provide full session records to the payment processor as evidence of service delivery.
- 5.5. Users acknowledge that fraudulent or baseless chargeback claims (e.g. "product not received") may result in account suspension, legal action, or financial penalties.
6. User Responsibilities
- Ensure accurate vehicle connection and adherence to station instructions.
- Monitor charging status via App notifications.
- Maintain sufficient wallet balance or valid payment method.
- Keep personal and payment information up to date.
7. Limitation of Liability
To the maximum extent permitted by law, HapiRide disclaims liability for:
- Losses due to User or vehicle error,
- Incomplete sessions caused by external factors,
- Any indirect, incidental, or consequential damages.
8. Data Collection & Privacy
HapiRide collects and stores session data for operational, billing, dispute resolution, and service improvement purposes. Full Privacy Policy is available within the App.
9. Account Suspension and Termination
HapiRide reserves the right to suspend or terminate User accounts in cases of:
- Fraudulent activity,
- Attempted, excessive, or repeated chargebacks,
- Violation of these Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia.
11. Updates to Terms
HapiRide reserves the right to modify these Terms at any time. Continued use of the App after such changes constitutes acceptance of the revised Terms.
By registering and using the HapiRide App, you acknowledge that you have read, understood, and agreed to these Terms of Use.
